Prohibition of carrying imitation firearms – Section 42a of the Weapons Act
It is prohibited to carry imitation firearms, bladed weapons as defined in Annex 1 Section 1 Subsection 2 No. 1.1 or knives with a locking blade (one-handed knives) or fixed-blade knives with a blade length exceeding 12 cm.
Imitation firearms are firearms which, according to their external form, give the overall impression of firearms (Annex 1 Section 1 Subsection 1 No. 2.1) and in which no hot gases are used to propel the projectiles, replicas of firearms with the appearance of firearms according to number 1 or rendered unusable firearms with the appearance of firearms according to number 1.
Excluded are items that are clearly intended for play (e.g., cap guns) or for traditional events (e.g., carnival, shooting festival parades) based on their overall appearance, or that are or are intended to be part of a culturally and historically significant collection within the meaning of Section 17, or firearms for which a permit to carry is required under Section 10 Paragraph 4 (e.g., gas and signal weapons, compressed air and compressed gas weapons).
The prohibition on carrying weapons does not apply to transport in a sealed container (e.g., shrink-wrapped packaging, lockable gun case) if a legitimate interest exists. A legitimate interest always exists if carrying the items is related to the exercise of a profession, the maintenance of customs, sports, or serves a generally recognized purpose, thus constituting socially acceptable use.
Shooters and other gun buyers:
The acquisition of long guns, handguns, and ammunition requires a firearms ownership license (WBK) or ammunition acquisition permit. The issuing authority enters the type of firearm and the authorization to acquire ammunition into the WBK after verifying the holder’s need, firearms expertise (test), and reliability (pre-entry). When you purchase a firearm, we will enter the type, manufacturer, model, and serial number. The acquisition must be reported to the issuing authority within 14 working days.
As proof of need and expertise, shooters receive a certificate from their clubs confirming regular participation in shooting practice. Holders of a NEW yellow firearms license for sport shooters can acquire single-shot long guns with smoothbore and rifled barrels, repeating long guns with rifled barrels, single-shot handguns for cartridge ammunition, and multi-shot percussion long guns and percussion handguns, as well as the corresponding ammunition (excluding powder), even without prior registration.
Hunter:
With a valid hunting license, you can purchase long guns and the corresponding ammunition. Long guns must be registered with the relevant authority within 14 working days.
Danger! Hunters must also apply for a firearms possession license with pre-entry for the purchase of handguns and their ammunition.
